Mr. Christiansen made a motion to combine items IIC and IID, Perry Homes.

Mr. Switzer 2nd the motion.

Mr. Sibley asked questions regarding the location of the business.

Ms Michele Benjamin, applicant: We want our customers to see us and the one sign is blocked by the landscaping. 

Mr. Christiansen asked is the proposed sign gong to be lit up.

Ms Benjamin responded yes.

Mr. Landis restated the staff report on this item.

Mr. Sibley asked if this sign would be covered by the marquee program.

Mr. Landis responded yes.

Mr. Sibley asked if KB Homes was aware of the marquee program.

Mr. Landis responded yes.

Mr. Switzer asked can you give us some timeline for this marquee sign.

Mr. Landis responded currently the marquee sign program is being reviewed by the City Attorney.  He has had it in his office for about a week.  I should get something back from him next week as long as the information that he had requested from me recently satisfies him we should be moving forward to Council probably in August.  So, if we get approval in August it will be sometime in late September before any signs are put up.

Mr. Tannos asked why is staff recommending denial.

Mr. Landis said we have set a precedence for the existing signs that are out there but staff feels that we shouldn’t increase that number of signs during this period.

Mr. Tannos asked doesn’t that place this company at a slight disadvantage.

Mr. Landis responded that is what this board will have to decide.

Mr. Sibley asked what is going to happen to the sign that is currently there; it is for a different builder at this same development?

Mr. Landis responded that is correct.  The remaining lots have been purchased by KB Homes and they will be the only builder.

Mr. Aaron Blinka, representing applicant: We need to try and drive traffic in our community.  Right now with the secluded location of our community it is very difficult for passers by to know we are back there.  Back to the other sign, they did not obtain a land lease from the gentleman who owns that property and he actually wants the sign removed so our sign would actually replace that sign.  He is asking our sign company to remove that sign and then install ours there in its place.  We are aware of the marquee program and are prepared to remove our signs as soon as the marquee program comes into effect.

Mr. Christiansen made a motion to grant a variance request on ZBA06-54 (KB Homes), from Section 90-144 of the City of League City’s Sign Ordinance for property located at 603T League City Parkway with a temporary permit, with prices accordingly set by Building Department and a time limit of six months on the signs or until the proposed marquee signage is approved by Council which ever comes first.

C.     Consider and take action on ZBA06-55 (Perry Homes #3), a variance request from Section 90-144 of the City of League City’s Sign Ordinance for property located at 1310T Gulf Freeway South.

Mr. Landis stated items IIC and IID need to be split because item IIC is an existing sign and item IID is proposed.

Mr. Christiansen made a motion to hear items IIC and IID separately, as originally listed.

Mr. Mark Vogel, representing Perry Homes: This is to direct traffic to South Shore HarbourPerry Homes is aware of the marquee sign program and understand that when this becomes effective all the other signs will come down.

Mr. Mark Vogel, representing Perry Homes: This is a new sign located off of Bay Area Boulevard for Friendswood Oaks next to all the other signs.

Mr. Sibley made a motion to deny variance request ZBA06-56 (Perry Homes #4), from Section 90-144 of the City of League City’s Sign Ordinance for property located at 4904T W. Main Street.

Mr. Wray 2nd the motion.

A discussion was held.

Mr. Christiansen made a motion to grant variances ZBA06-57, ZBA06-58, ZBA06-59, ZBA06-60, ZBA06-61, ZBA06-62, and ZBA06-63 (South Shore Harbour Development) as requested with a temporary permit, with prices accordingly set by Building Department and a time limit of six months on the signs or until the proposed marquee signage is approved by Council which ever comes first.

The motion to grant variances ZBA06-57, ZBA06-58, ZBA06-59, ZBA06-60, ZBA06-61, ZBA06-62, and ZBA06-63 (South Shore Harbour Development) as requested with a temporary permit, with prices accordingly set by Building Department and a time limit of six months on the signs or until the proposed marquee signage is approved by Council which ever comes first was unanimous, 5 – 0 – 0.

L.     Consider and take action on ZBA06-64 (Capital One), a variance request from Section 90-110a of the City of League City’s Sign Ordinance for property located at 1815 FM 646 West.

Mr. Landis restated the staff report on this item.

Mr. Christiansen asked if there was someone here to represent the applicant.

Mr. Don Sturr, 2611 El Camino, Houston Texas.

Mr. Brian Mattis, 16709 Davy Jones, Jamaica Beach, Texas.

Mr. Sturr stated National Signs does just about all the Capital One locations in the state of Texas and this is their standard branding image which include the signs in front and on all three sides.  The five signs on the front of the building are just actually 4 inch little plastic letters that go above the windows that advertise and promotes their banking services.  These letters are just installed on existing architectural metal that the contractor installed.  We just add the lettering.  We are requesting to maintain the consistency throughout all of their branches across Texas

Mr. Christiansen asked what surrounds this property.

Mr. Mattis responded the HEB is located directly across the street with a Bank of America.  The west side of the building is a Valero gas station, directly behind the building is a field that I am sure is zoned for residential and on the east side of the building is just a field.

Mr. Sibley asked how tall is the sign that you want to put up in the back.

Mr. Sturr responded they are 18 inches by 13 ft, 3 in.

Mr. Christiansen said I am not sure who would be able to see the sign that is on top of the drive through.

Mr. Mattis responded the housing development that is behind it, it what we would be targeting.

Mr. Christiansen asked if the signs on all four sides that say Capital One will be illuminated and the little 4 inch ones in the front are just plastic.

Mr. Sturr responded yes, sir.

Mr. Sibley asked from the edge of your building to the drive through, how many feet are you going to have to the property line on the south side toward the detention, 10, 15, 20 feet?

Mr. Mattis responded yes your approximation is correct.

Mr. Christiansen made a motion to approve variance ZBA06-64 (Capital One), request from Section 90-110a of the City of League City’s Sign Ordinance for property located at 1815 FM 646 West as proposed with the exception on the signage on the south side rear drive through canopy.

Mr. Wray 2nd the motion.

A discussion was held.

Mr. Landis restated the staff report on this item.

Mr. Christiansen confirmed this property was in the HEB parking lot with the back facing HEB and the front facing I-45.

Ms Karen Patterson, representing Taco Cabana: This is a new proto-type store for Taco Cabana and they have what they call a tower in front and they have always had three signs on the building and one across the drive-though.  This is the standard sign package that they do at all of their locations. 

Mr. Sibley made a motion to grant variance ZBA06-65 (Taco Cabana), request from Section 90-110a of the City of League City’s Sign Ordinance for property located at 2885 Gulf Freeway South.

III.   The Swearing in of Witnesses

Mr. Christiansen swore in the witnesses, stating this is a quasi-judicial board, which is being recorded and therefore anybody that speaks should be aware it is considered testimony.  Any appeal of the decision by the Board of Adjustment must be filed with the Court of Competent Jurisdiction within 10 days of the date of the decision rendered by this board or such different time period if any as provided by Section 216- 01B, Subsection A of the Texas Local Government Code.

IV.    Public Hearings         

A.     Conduct public hearings and take action on ZBA06-48 (Boat Barn Request #2), a variance request to the requirement (Section 125-170.G.2) that the driveway located at 516 Hobbs Road be constructed in a manner and with materials similar to the frontage roadway (Hobbs Road); and on ZBA06-52 (Boat Barn Request #3), a variance request to the minimum driveway width requirement (Schedule 125-170.G-1) of 35 feet for an arterial street located at 516 Hobbs Road.

Ms Holmes restated the staff report for these requests stating the applicant was granted a variance at your last meeting allowing the applicant to construct the driveway of asphalt however this request the owner would also like to use crushed concrete on portions of the interior drive.  The ordinance only allows concrete however staff would be able to support a variance for asphalt but not crushed concrete.  The other request is for the driveway where it meets Hobbs Road to be less than 35 feet.  This is basically for turning radius.  This driveway was previously constructed and staff has no objections to this variance considering it is already existing and I have checked with the fire department and they can get a fire truck there safely.

Mr. Sibley stated crushed concrete allows drainage that asphalt does not therefore you do not need a retention pond because you are not paving everything over.

Mr. Steve White, representing applicant: When we came last month we had a preliminary plan.  Now we have had a full DRC meeting and this the plan we came up with.  The apron at Hobbs Road was installed by the City when they widened it, and it is roughly 28 ft. at the property line.   With the driveway we are planning to use asphalt on the main drive and the parking lot of the office.  We would like to use what is called “washout”, which is essentially recycled concrete on the interior drives and the insides of our new buildings.  The buffering, detention area, and landscaping will hide any objections to the aesthetics and the variance requests are in keeping with the original design of the property.

Mr. Switzer asked what is inside your existing buildings.

Mr. White responded the same thing, crushed stone.

Mr. Sibley made a motion to grant both, ZBA06-48 (Boat Barn Request #2), a variance request to the requirement (Section 125-170.G.2) that the driveway located at 516 Hobbs Road be constructed in a manner and with materials similar to the frontage roadway (Hobbs Road); and on ZBA06-52 (Boat Barn Request #3), a variance request to the minimum driveway width requirement (Schedule 125-170.G-1) of 35 feet for an arterial street located at 516 Hobbs Road.

Ms Holmes restated the staff report on this item.  We received one letter from a property owner that owns three lots that came after you received your staff report and he was in favor of the granting of this variance.

Mr. Milton Pyron, representing YMCA: This is a typical YMCA package but smaller and the 50% transparency is not feasible based on the uses of the building mostly because of the structural diagonal bracing and the gym.

Ms Holmes restated the staff report on this item stating staff can support this as the State has been working with the applicant due to Hwy 96/ League City Parkway crossover.

Mr. Tannos asked if this was Star Toyota.

Ms Holmes responded yes.

Mr. Sibley said this was old Phase Electric next to Mrs. Baird’s Bread.

Mr. Tannos corrected Mr. Sibley on the location. 

Mr. Sibley confirmed with Ms Holmes, the City had no problems with this request.

Mr. Christiansen asked if there was an applicant or representative present.

Mr. Christiansen opened the public portion of this hearing at 7:51 pm.

Mr. Peifer stated he would be happy to answer any questions regarding State Hwy 96 project and the negotiations that are currently in process with Mr. Hibbard, Star Toyota, their holding entity as well as TxDOT and their contractor who I am meeting with next week on some of these issues.

V.      Comments from Board Members

Mr. Sibley said he thought the percent of transparency was ridiculous due to the smash and run.  Every time that one comes up you will see me go bananas so you might want to see about getting that changed.  I can understand about a retail business you want to have store windows so we are going to have this transparency and we are going to have a heck of a business in burglar bars.

Mr. Christiansen asked for a copy of the Open Meeting Act Training CD.

Recording secretary responded she would be happy to provide him with one.

Mr. Switzer said I have a real hard time approving a variance for people that do not show up for the meeting.

Mr. Landis stated we had our budget meetings last week and we had some pretty positive questions from City Council when it came to funding the rewrite of the sign ordinance.  The intent of staff is ultimately to rewrite the sign ordinance, like some neighboring cities, that addresses every issue where you can not get a variance to the sign ordinance.
