(Previous joint public hearings with City Council held on February 7th, February 15th, and June 16th, and June 20th.)

Call to order and Roll call of members of Planning & Zoning Commission

 

Mr. Owens called the meeting to order at 6:03 p.m.

II.        Approval of Minutes for Planning and Zoning Commission           

A.         June 20, 2011

 

Mr. Koonce made a motion to approve the minutes of the June 20th meeting.

Mr. Owens seconded the motion.

The motion to approve was adopted by a vote of 5-0-0

Mr. Koonce made a motion to combine the public hearings.

Mr. Owens seconded the motion.

The motion was adopted by a vote of 5-0-0.

 

VI.        Public Hearings and Action Items from Public Hearings

  C.      Hold a fifth public hearing and take action on proposed amendments to Chapter 125, Code of Ordinances of the City of League City, Texas entitled “Zoning” to revise regulations for oil and gas well drilling, excavation and mining. (Previous joint public hearings held on February 7th, February 15th, June 16th, and June 20th.) 

 

  D.      Hold a fifth public hearing and take action on proposed amendments to Chapter 42, Code of Ordinances of the City of League City, Texas entitled “Environment” to revise regulations for oil and gas wells and pipelines. (Previous joint public hearings with City Council held on February 7th, February 15th, and June 16th, and June 20th.)

 

LaShondra Holmes, Planning Manager informed the Commission that staff met with Councilman Becker and Commissioner Landon after the June 20th meeting to discuss safety measures.

Ms. Holmes added that the provisions were added to the document.

Ms. Holmes added that staff did not make any changes to the setbacks section. Ms. Holmes stated that staff requested that the Commission vote on a number for this section if they wanted to change it.

Mr. Hullman opened the public hearing at 6:08 pm. With no individuals to come forward, Mr. Hullman closed the public hearing at 6:09 pm.

A discussion was held.

Mr. Hullman cited concern that ambient noise level was removed in favor of a decibel level of 70 for all uses.

 

Ms. Holmes in response stated that the applicant may choose between an ambient study and a noise level of 70 decibels.  

 

Tony Allender, Director of Planning & Research stated that a normal noise decibel is between 60-70 decibels.

 

Mr. Allender further stated that the idea was that an applicant could choose to pay for an ambient study rather than to comply with the decibel level.  

 

Commissioner Landon led a discussion regarding the setbacks to water wells.

 

Mr. Landon stated that personal water wells will be located close to the residential dwelling due to the costs of pumping.

 

Mr. Hullman in response stated that he was concerned more so about public safety in regards to the location of the setbacks for water wells.

 

Mr. Landon added that drilling within 250 feet of the City’s water supply would be a public safety concern.

 

Mr. Hullman stated that there isn’t language in the ordinance to protect drilling near the City’s water supply. 

 

In regards to water wells, Ms. Holmes suggested that the Commission add a sentence to the ordinance that reads excluding any municipal, private or public water wells that serve multiple residences or businesses shall be determined by the City on an individual basis but no less than 200 feet.

 

Mr. Hullman made a motion to approve the proposed amendments to Chapter 125, Code of Ordinances of the City of League City, Texas entitled “Zoning” to revise regulations for oil and gas well drilling, excavation and mining and Chapter 42, Code of Ordinances of the City of League City, Texas entitled “Environment” to revise regulations for oil and gas wells and pipelines subject to the following:

 

1.      The title of Chapter 42, Article 3 be changed to “Oil and Gas Well Drilling.”

2.      The title of Chapter 42, Article 4 be changed to “Drilling Production, Plugging and Abandonment.”

3.      Add the language, “Excluding any municipal, private or public water wells that serve multiple residences or businesses shall be determined by the City on an individual basis but no less than 200 feet” to Chapter 125.90.G., Item 1C and all other water well setback references.

4.      The oil and gas well drilling operation decibel levels will remain 70 decibels in Chapter 125. However, in Chapter 42 the noise levels will be limited to the City of League City’s noise ordinance that was approved prior to the existing noise ordinance.

5.      Change the word “Conservation” to “Commission” in Chapter 125.

 

Mr. Landon seconded the motion.

 

The motion was adopted by a vote of 5-0-0.  

 

 

V.           Reports from Staff

A.  Report of Council Action on Planning and Zoning Commission Items

 

LaShondra Holmes, Planning Manager stated that the annual Planning & Zoning Commission training workshop will be on July 18th.

 

Ms. Holmes added that the Pinewood Ranches zoning change request was tabled by City Council and will go forward on July 12th.

 

Mr. Hullman asked if City Council has taken action on the Boyd PUD. Ms. Holmes in response stated that it has been tabled until August 9th.

 

VI.              Adjournment

   Mr. Hullman adjourned the meeting at 6:45 pm.
