II.    Approval of Minutes

 

A.     February 02, 2012

 

Ms. Kosty made a motion approve the minutes of February 2, 2012 with noted revisions.

Mr. Stephenson seconded the motion.

The motion passed unanimously with a vote of 6-0-0.

III.          Swearing in of Witnesses

 

Mr. Christiansen swore in the witnesses, stating this is a quasi-judicial board, which is being recorded and therefore anybody that speaks should be aware it is considered testimony.  Any appeal of the decision by the Board of Adjustment must be filed with the Court of Competent Jurisdiction within 10 days of the date of the decision rendered by this board. 

 

 IV.      Public Hearings and Action Items from Public Hearings

Mr. Christiansen read aloud the General Procedures and Instructions to Participants for all Dangerous Building Hearings.

 

Mr. Arevalo, Building Official, presented the staff report for this item.  Mr. Davidson, Building Inspector, presented photos of the property and dilapidated structures.

 

Susan Scruggs, property owner, came forward representing herself as well as her husband, Edwin T. Scruggs, III, who was not present at the meeting due to an illness.   She further noted that the name Edward Scruggs, Jr. listed as an Owner/Lienholder was in error as the individual listed is of no relation to her or to her husband.

Ms. Scruggs referred to the photos to help identify the multiple structures on the property.  The Board determined that the structures on the property included:  A. Ranch house, B. Well house, and C. Shed.  It was determined that the other two structures identified in the photos were not on Ms. Scrugg’s property but part of the adjacent property.

 

Ms. Scruggs advised that she has contracted with Cherry Demolition to demolish the three structures on the property.  She further advised that the company said the demolition could take place in a short period of time, possibly within a month.

 

Mr. Weathered reviewed and discussed with the Board the Form Order contained in the Commissioner’s packets.  Mr. Arevalo recommended a 60 day demolition compliance date.  The Board agreed to a proposed date of June 4th.  

Mr. Christiansen opened the public portion of the hearing at 6:48 p.m.  With no one present from the public to speak on this item, Mr. Christiansen closed the public portion of the hearing at 6:48 p.m. and called for a vote.

Ms. Kosty advised that she would not be voting on this item as it was recommended by the City Attorney that she recuse herself from the vote.  Mr. Christiansen activated Alternate I, Katie Benoit as a voting member in Ms. Kosty’s place.

The Board voted unanimously to accept the order as discussed for item ZBA12-02 (3017 Grissom Road).

The Board recessed briefly from 6:51 p.m. until 7:00 p.m. to finalize the order.

 

B.  Hold a public hearing and take action on ZBA12-03 (710 West Main Street), to determine whether a building or structure is a dangerous building, and issue any order(s) determined necessary to address such conditions per 22-331 et. seq. of the League City Code of Ordinances on properties legally described as a portion of Block L (12-0-14 and 12-0-25) of the Clear Creek Subdivision in League City, Galveston County, Texas, according to the record file under Galveston County Clerk’s File Number 2008050635 of the records of Galveston County, Texas.

Mr. Christiansen bypassed reading the General Procedures and Instructions to Participants for all Dangerous Building Hearings since there was no one present from the public in the audience.

 

Mr. Arevalo presented the staff report for this item.  He advised that he has not been in contact with Ms. Blackman but had received a call from the law firm representing the bank holding the lien on the property.  The representative of the firm advised, after viewing photos of the property, they would not contest the action of the Board.   Mr. Davidson presented and reviewed photos of the property and identified the structures as:  A. Residential dwelling structure, B. Concrete slab.

 

Mr. Weathered reviewed and discussed with the Board the Form Order contained in the Commissioner’s packets.  Mr. Arevalo advised that as of yet, staff has had no response from the property owner so it is likely the city will be carrying out the demolition process.   He recommended a 30 day demolition compliance date.  The Board agreed to a proposed date of May 3rd.

With no further questions or comments, Mr. Christiansen called for a vote.

The Board voted unanimously to accept the order as discussed for item ZBA12-03 (710 West Main).

V.      Adjournment

 

Mr. Christiansen adjourned the meeting at 7:18 p.m.
