C.      Hold a public hearing and make a recommendation on Special Use Permit Application, SUP12-03 (Gordon), for a gas and service station use on approximately 1.7 acres on property zoned ?CM? (Commercial Mixed Use), legally described as Lot 15 of Division ?C? in League City Subdivision, generally located north of Abilene Street, east of FM 270 and west of St. Christopher Avenue, with the approximate address being 345 FM 270 in League City, Texas.

D.      Hold a public hearing and make a recommendation on Zone Change Application, Z12-07 (Thomas), a request to rezone approximately 3.3 acres from ?RSF-5? (Single-family residential with a minimum lot size of 5,000 square feet) to ?CG? (General Commercial), legally described as all of Blocks 256-258 of the Moore?s Addition To The Town of Dickinson, generally located north of FM 646 and west of Highway 3, with the approximate address being 301 West FM 646, League City, Texas.

 

V.                 New Business

A.      Consider and take action on a Buffer Yard Variance Application, BP12-02 (TNMP Butler Road Substation #3), a request to eliminate a requirement for a 30-foot landscaped buffer yard along the northern property line adjoining ?PS? (Public / Semi-Public) zoning for a major utilities [electrical substation] use, generally located north of League City Parkway and east of Butler Road, with the approximate address being in the 1400 block of Butler Road in League City, Texas.

Approval of Minutes

B.      November 19, 2012

 

Mr. McKillip made a motion to approve the minutes of the November 19th meeting.

Mr. Froeschner seconded the motion.

The motion to approve was adopted by a vote of 6-0-2.

Mr. Landon and Mr. Koonce abstained from voting stating that they were not present for the November 19th meeting date.

B.      Consider and take action on a Buffer Yard Variance Application, BP12-02 (TNMP Butler Road Substation #3), a request to eliminate a requirement for a 30-foot landscaped buffer yard along the northern property line adjoining ?PS? (Public / Semi-Public) zoning for a major utilities [electrical substation] use, generally located north of League City Parkway and east of Butler Road, with the approximate address being in the 1400 block of Butler Road in League City, Texas.

 

Mark Linenschmidt, Senior Planner restated the staff report for these items.

Ms. Linenschmidt informed the Commission that the application is for rezoning two adjacent tracts, totaling approximately 5.1 acres from ?OS? (Open Space) and ?CM? (Commercial Mixed Use) to ?PS? (Public/Semi-Public) and a Special Use Permit (SUP) for a ?major utility? use and a variance to eliminate a required 30-foot landscaped buffer yard with intent to construct an electrical substation directly adjacent to the transmission lines that run east-west, due to the growth and density in League City.

The applicant indicates that a new substation is needed for 1) providing redundancy to the existing distribution system; and 2) to account for the electrical needs of the UTMB medical campus, which is approximately 2,500 feet to the southwest. Texas New Mexico Power Company is one of two companies (the other is Centerpoint) that installs and maintains the electric lines within League City. After deregulation of the electricity industry, in 2002, power companies are no longer permitted to generate and transport electricity across the electrical grid in Texas.

Mr. Hullman stated that the public hearings for each agenda item would be held separately.

Mr. Hullman added that the Commission would take action on the items separately.

Mr. Hullman opened the public hearing at 6:18 pm for Zone Change Application, Z12-06 (TNMP Butler Road Substation #1).

With no individuals to come forward Mr. Hullman closed the public hearing at 6:19pm.

Mr. Koonce made a motion to approve Zone Change Application, Z12-06 (TNMP Butler Road Substation #1).

Mr. Hamilton seconded the motion.

The motion to approve was adopted by a vote of 8-0-0.

Mr. Hullman opened the public hearing for Special Use Permit Application, SUP12-04 (TNMP Butler Road Substation #2) at 6:21pm.

 

With no individuals to come forward Mr. Froeschner closed the public hearing at 6:21pm.

Mr. McKillip made a motion to approve for Special Use Permit Application, SUP12-04 (TNMP Butler Road Substation #2) subject to all efforts being made for access to be gained off of Phillips Lane.

Mr. Landon seconded the motion.

Mr. Hullman suggested that an additional condition be included in the approval. Mr. Hullman suggested that the proposed landscaping plan shall remain intact and act as a natural screen for the facility.

Mr. McKillip amended his motion.

Mr. Landon amended his second.

The motion to approve was adopted by a vote of 8-0-0.

Mr. Froeschner made a motion to approve Buffer Yard Variance Application, BP12-02 (TNMP Butler Road Substation #3) subject to City Council?s approval of the zoning change application and special use permit application.

Mr. Matlock seconded the motion.

The motion to approve was adopted by a vote of 8-0-0.

C.      Hold a public hearing and make a recommendation on Special Use Permit Application, SUP12-03 (Gordon), for a gas and service station use on approximately 1.7 acres on property zoned ?CM? (Commercial Mixed Use), legally described as Lot 15 of Division ?C? in League City Subdivision, generally located north of Abilene Street, east of FM 270 and west of St. Christopher Avenue, with the approximate address being 345 FM 270 in League City, Texas.

 

Joey Kaspar, Planner restated the staff report for this item.

 

Ms. Kaspar informed the Commission that the application is for a special use permit to allow a ?gas and service station? on property that is currently zoned ?CM? (Mixed Use Commercial).   A 6,980 square foot building for a convenience store with 10 gas pumps under an awning is being proposed on the northern portion of the property with a detention pond located on the southern portion. 

Mr. Hullman opened the public hearing at 6:38pm.

With no individuals to come forward Mr. Hullman closed the public hearing at 6:39pm.

Mr. Matlock made a motion to approve Special Use Permit Application, SUP12-03 (Gordon) subject to there being a natural barrier encompassing the detention pond.

Mr. Turner seconded the motion.

The motion to approve was adopted by a vote of 8-0-0.

D.      Hold a public hearing and make a recommendation on Zone Change Application, Z12-07 (Thomas), a request to rezone approximately 3.3 acres from ?RSF-5? (Single-family residential with a minimum lot size of 5,000 square feet) to ?CG? (General Commercial), legally described as all of Blocks 256-258 of the Moore?s Addition To The Town of Dickinson, generally located north of FM 646 and west of Highway 3, with the approximate address being 301 West FM 646, League City, Texas.

 

Joey Kaspar, Planner restated the staff report for this item.

Mr. Kaspar informed the Commission that the application is to rezone approximately 3.3 acres from ?RSF-5? (Single-family residential with a minimum lot size of 5,000 square feet) to ?CG? (General Commercial). The applicant has not proposed any specific use for the property at this time. 

Mr. Hullman opened the public hearing at 6:54pm.

Mr. Hamilton made a motion to approve Zone Change Application, Z12-07 (Thomas).

Mr. Koonce seconded the motion.

The motion to approve was adopted by a vote of 8-0-0.
