A.     Hold a public hearing and make a recommendation to City Council on a Special Use Permit Application, SUP13-05 (BridgeTex Pipeline), to construct a pipeline within an existing 100-foot wide Centerpoint Energy / Interurban Right-of-Way easement being approximately 16,310 feet in length and containing approximately 32.4 acres on property zoned “OS" (Open Space)  and “OS-CRC” (Open Space with a Commercial Revitalization Overlay), legally described as portions of Lots 1 thru 3 (1-14), Block A, of the Clear Creek Subdivision, Tract 106, 107, and 108 of the Stephen F Austin Survey and Tracts 1 and 132 of the Perry & Austin Survey, generally located north and south of Farm to Market Road 518, League City Parkway and Farm to Market Road 646, west of Highway 3 in the City of League City.

B.     Hold a public hearing and make a recommendation to City Council on a Special Use Permit Application, SUP 13-07 (AT&T Mobility), for a special use permit to erect a Communication Tower on property generally located on the southeast corner of I-45 and Wesley Dr., legally described as ABST 3 PT OF RES F (6-1) CLEAR CREEK CROSSING.

 

IV.              Public Hearings and Action Items from Public Hearings

A.     Hold a public hearing and make a recommendation to City Council on a Zoning Change Application, Z13-08 (CCISD), a request to rezone approximately 24.4 acres from “CM” (Commercial Mixed Use) to “PS” (Public Semi-Public), generally located east of West NASA Road and south of FM 528, legally described as Tract 26Q Abstract 15 J Dickinson, Lots 9 and TRS 1C, 4A, 5A, 10A, & Webster Outlots 9.

 

V.                 New Business

A.     Consider and take action on a Site Plan – Dunkin Donuts, generally located northeast of FM 270 and west of FM 2094.

B.     Consider and take action on a Preliminary Plat – Autumn Lakes Section 5, generally located south of Grissom Road, east of Bay Area Boulevard. 

C.     Consider and take action on a Preliminary Plat – Bay Colony Pointe West Section 9, generally located north of Farm to Market Road 517 and west of Calder Road.  

D.     Consider and take action on a Preliminary Plat – Bay Colony Pointe West Section 10, generally located north of Farm to Market Road 517 and west of Calder Road.

I.                   Call to order and Roll call of members of Planning & Zoning Commission

 

Mr. Froeschner called the meeting to order at 6:50 p.m.

II.                Approval of Minutes

A.     December 16, 2013

 

Mr. Matlock made a motion to approve the minutes of the December 16th P&Z meeting with the corrections as presented by staff.

Mr. Turner seconded the motion.

The motion to approve was adopted by a vote of 6-0-0.

III.             Tabled and Subject to Recall

Tony Allender, Director of Planning & Development came forward to address the Commission.

 

Mr. Froeschner continued the public hearing at 6:56pm.

 

With no individuals to come forward Mr. Froeschner closed the public hearing at 6:57pm.

 

Mr. Matlcok made a motion to approve Special Use Permit Application, SUP13-05 (BridgeTex Pipeline) subject to the conditions as presented in the staff report:

1.      Bollards shall be installed around the perimeter of the valve station site outside of the fencing.

2.      The Contractor must provide at least 48 hours notice to the Oil & Gas Coordinator prior to crossing any water mains measuring 24-inches or larger, in support of Water Production’s request to be on-site during these crossings.

3.      The applicant must provide as-built drawings to the Planning Department and Emergency Management Department upon completion of the pipeline.

 

Mr. Turner seconded the motion.

 

The motion to approve was adopted by a vote of 6-0-0.

 

B.   Hold a public hearing and make a recommendation to City Council on a Special Use Permit Application, SUP 13-07 (AT&T Mobility), for a special use permit to erect a Communication Tower on property generally located on the southeast corner of I-45 and Wesley Dr., legally described as ABST 3 PT OF RES F (6-1) CLEAR CREEK CROSSING.

 

Wes Morrison, City Planner informed the Commission that the applicant has requested that this item remains tabled.

IV.              Public Hearings and Action Items from Public Hearings

A.  Hold a public hearing and make a recommendation to City Council on a Zoning Change Application, Z13-08 (CCISD), a request to rezone approximately 24.4 acres from “CM” (Commercial Mixed Use) to “PS” (Public Semi-Public), generally located east of West NASA Road and south of FM 528, legally described as Tract 26Q Abstract 15 J Dickinson, Lots 9 and TRS 1C, 4A, 5A, 10A, & Webster Outlots 9.

 

Karl Almgren, Planner restated the staff report for this item.

 

Mr. Almgren informed the Commission that the request is to rezone approximately 24.4 acres of undeveloped land from “CM” (Commercial Mixed Use) to “PS” (Public Semi-Public) and amend the Future Land Use Plan of the 2035 Comprehensive Plan from Urban Low to Public/Institutional.

 

Mr. Froeschner opened the public hearing at 7:02pm.

 

James Whiteley, 3007 Massengale Ln.: Voiced his concerns in regards to increased traffic due to major events. 

 

With no individuals to come forward Mr. Froeschner closed the public hearing at 7:04pm.

 

Mr. Hamilton made a motion to approve Zoning Change Application, Z13-08 (CCISD).

 

Ms. Harding seconded the motion.

 

The motion to approve was adopted by a vote of 6-0-0.

 

V.                 New Business

A.     Consider and take action on a Site Plan – Dunkin Donuts, generally located northeast of FM 270 and west of FM 2094.

 

Karl Almgren, Planner restated the staff report for this item.

 

Mr. Almgren informed the Commission that the application is for site plan approval for development of an Eating and Drinking Establishment with Drive-Through Facilities and Outdoor Seating.

 

Mr. McKillip made a motion to approve the Site Plan – Dunkin Donuts.

 

Mr. Hamilton seconded the motion.

 

The motion to approve was adopted by a vote of 6-0-0.

 

B.     Consider and take action on a Preliminary Plat – Autumn Lakes Section 5, generally located south of Grissom Road, east of Bay Area Boulevard. 

 

Karl Almgren, Planner restated the staff report for this item.

 

Ms. Almgren informed the Commission that the application is for the Subdivision of 32.59 acres of previously unplatted property to create 113 single-family lots and 6 restricted reserves for landscaping, drainage, and utilities.

 

Mr. Froeschner allowed public comments at this time.

 

Dustin Gohmert, 2922 Massengale Ln.: Mr. Gohmert requested that the Commission take the property owner’s drainage concerns into consideration.

 

Linda Whiteley, 3007 Massengale Ln.: Ms. Whiteley requested that the Commission postpone action until the property owners are able to present their proposal to City Council to purchase a portion of land on Massengale Lane for right of way dedication.

 

Thomas Tran, 2934 Massengale Ln.: Mr. Tran requested that action is postponed until staff has the opportunity to research drainage concerns.

 

Mr. Matlock made a motion to approve Preliminary Plat – Autumn Lakes Section 5.

 

Mr. Turner seconded the motion.

 

The motion to approve was adopted by a vote of 6-0-0.

 

C.     Consider and take action on a Preliminary Plat – Bay Colony Pointe West Section 9, generally located north of Farm to Market Road 517 and west of Calder Road. 

 

D.     Consider and take action on a Preliminary Plat – Bay Colony Pointe West Section 10, generally located north of Farm to Market Road 517 and west of Calder Road.

 

Wes Morrison, City Planner restated the staff report for these items.

 

Mr. Morrison informed the Commission that the application for Bay Colony Pointe West Section 9 is for the subdivision of approximately 8.2 acres of unplatted property to create 39 residential lots and 1 restricted reserve for landscape/ open space.

 

Mr. Morrison further informed the Commission that the application for Bay Colony Pointe West Section 10 is for the subdivision of approximately 5.2 acres of unplatted property to create 17 residential lots and 2 restricted reserves for landscape/ open space.

 

Mr. Matlock made a motion to approve Bay Colony Pointe West Section 9 and Bay Colony Pointe West Section 10.

 

Mr. Turner seconded the motion.

 

The motion to approve was adopted by a vote of 6-0-0.
