HISTORIC DISTRICT COMMISSION

REGULAR MEETING

Thursday, January 15, 2015 at 6:00 P.M.

I.                   Call to Order and Roll Call of Members

Chairman Guglielmo called the meeting to order at 6:10 PM.

II.                Approval of Minutes

A.                 November 20, 2014

 

Minutes indicate Dick Calkins was not present for the meeting, he was there, and he was just late.  Staff will correct minutes to reflect that he was present for the November 20, 2014 meeting.

 

Fay Dudney motioned to approve the Minutes of November 20, 2014.

Elizabeth Schroeder seconded the motion.

Motion passed 5-0-0.

 

III.             Public Hearing & Action Items

A.                 HC15-01a.Hold a public hearing and take action on a request for a Certificate of Appropriateness to replace four windows on the north and east sides of the structure; and to replace the siding on the north, east, and west sides of the structure at 812 East Main Street (FM 518), located along the north side of East Main Street (FM 518) and east of Kansas Avenue.

Kris Carpenter presented for the City of League City.

He gave background information on the property, letting the commission know that building permits were already issued for the property.

 

Applicant, Noah Espinoza, addressed the commission.  He informed the commission that the project was initiated due to a new tenant who was doing some remodel, he found significant termite damage.  He was worried about making sure the house was closed up and secure quickly.

 

Peter Guglielmo opened the Public Hearing at 6:19 PM.

Steph McDougal spoke noting that when work is already done, it is still important to review the completed work as though it were a proposal.  She does not take issue with the two non-double pained windows because they do not face the right of way.  She believes the siding was well chosen, and the work has been done well. She said that if this was a proposal of work to be done, instead of work already done, she wouldn?t have any problems approving the plans.

 

Peter Guglielmo wanted to stress that this isn?t the first time that the building department has issued permits prior to a Certificate of Appropriateness being issued.

Steph McDougal mentioned that other cities have measures in place to prevent that from happening, and wants staff to look into it.

Richard Werbiskis answered for the City of League City informing the commission that we have new software in place, with plans to incorporate GIS and further streamline this process to prevent issues in the future.

 

Steph McDougal asked what the time frame is for the software updates.

Richard Werbiskis said that at least six months. 

 

Steph McDougal asked for staff to keep the commission updated on the status of the software updates.

 

Steph McDougal motioned to approve Certificate of Appropriateness for HC15-01a ? replacement of siding windows.

Fay Dudney seconded the motion.

Motion passed 5-0-0.

 

B.                 HC15-01b.:  Hold a public hearing and take action on a request to allow a wooden fence securing the rear of an existing metal building at 804 East Main Street at the northeast intersection of East Main Street (FM 518) and Kansas Avenue.

Kris Carpenter presented for the City of League City.

He gave background information regarding the fencing, letting the commission know that the work has already been done. Fencing is necessary for screening of storage.  Kris informed the commission that the applicant has been notified that outdoor materials storage is not allowed, but outdoor vehicle storage is allowed in this use district. Ordinance requires 20% transparency, and Kris gave commission an idea on how this could be achieved with lattice work.

 

Fay Dudney asked staff if the dumpster is supposed to be enclosed.

Kris said yes, and he is talking to the applicant regarding that requirement.  

 

Noah Espinoza addressed the commission.  He informed the commission that he recently purchased the property and put up fencing because it was an eyesore from the front of the business. He also needed a fence for security of his tools and other business materials. He also informed the commission that he will need to fix the parking lot because it is full of pot holes. He did not encroach they alley way, but stayed inside his property lines one foot with his fencing.

 

Kris Carpenter addressed the commission regarding the ordinance not being clear on fence placement when there is a corner lot resulting in two frontages. The city considers the primary frontage to be on Main Street.

 

The commissioners had some questions as to what direction the front door faces.

Kris asked the property owner to verify, and it is on Main Street, not Kansas.

 

Peter Guglielmo opened the Public Hearing at 6:39 PM.

Noah Espinoza, applicant, addressed the commission. He wanted to inform them that the dumpster will be placed behind the fencing on Main Street so that the tenants next door can use the dumpster as well.

Steph McDougal wanted to verify that because the front of the property is Main Street, the only issue not in compliance currently would be the lack of the 20% transparency requirements.

Kris Carpenter verified that that is a correct statement.

Peter Guglielmo closed the Public Hearing at 6:47 PM.

 

A discussion was held about adding to the top of the current fence, allowing a variance on the fence, or adding to the height of the fence that is there.

 

Steph McDougal stated that if they have the ability to authorize a variance then it makes more sense to do so because the building is already in violation of the transparency requirements, and the building style itself isn?t in congruency with the district, so enforcing the district transparency fencing requirements would defeat the purpose because the fence is screening the storage for the business.

Elizabeth Schroeder agrees that a variance for this specific fence would be appropriate.

Fay Dudney mentioned that because the point is to approve the appearance of Main Street, enforcing standards would be good for the district.

A discussion was held regarding allowable height requirements for fencing.

Richard Werbiskis addressed the commission and informed them that staff is working with the applicant to provide landscaping to screen the fence and improve curb appeal to the property.

 

Steph McDougal motioned to grant a variance on the transparency requirements for the fence and leave the fence as built with the condition that they add landscaping to further screen the fence and approve the curb appeal of the property.

Elizabeth Schroeder seconded the motion.

The motion passed 5-0-0.

 

IV.              Commissioners? Comments

Dick Calkins spoke to the applicant letting him know that his parking lot is flood proned, and he would need to consider materials to help abate that problem when he is deciding how to repair his parking lot.

A discussion was held regarding the procedures and steps that need to be updated, and it was decided that they will address some of the issues at the next meeting, specifically about historic preservation.

 

V.                 Staff Comments

Richard Werbiskis spoke for the City of League City.

There is an opportunity to have a workshop / public forum with public works and the commission regarding drainage issues. Representatives from invested parties will be available to meet at the next Historic Commission meeting.

There is an Envisioning Workshop on Saturday, January 24, 2015 from 9AM ? 1PM. All residents are invited to the workshop. This is to discuss the growth of the City, and the desires of the citizens for that growth and development.
