MINUTES

CITY OF LEAGUE CITY

PLANNING AND ZONING COMMISSION

Monday, November 16, 2015 at 6:00 P.M.

COUNCIL CHAMBERS

I.                   Call to Order and Roll Call of Members

Douglas Turner opened the meeting at 6:00 PM.

II.                Approval of Minutes

A.     November 2, 2015

 

Mr. Dugie motioned to approve the November 2, 2015 minutes.

Mr. Arnold seconded the motion.

The motion passed by a vote of 5-0-1.

 

III.             Public Hearing

B.     Hold a public hearing and take action on a Partial Replat of Lots 1, 2, 13, 14 and 50? x 10? Alley of Clear Lake Subdivision to create Lot 1 Block 1 of the Clear Lake Subdivision; generally located north of Marina Bay Drive (FM 2094) and west of Lakeside Drive with an approximate address of 2828 Oak Road.

Matthew Grooms, Planner, presented for the City of League City. City recommended approval of the replat.

 

Mr. Dugie asked if the current owner is the same owner from when the building was demolished.

Mr. Grooms stated that the current owner purchased the property before the building was demolished.

 

Mr. Dugie asked if the current owner knew that if they demolished the building there would have to be a replat.

Mr. Grooms stated that he believed that the owners were aware, but had not conversed with them on the subject, as the applicant came forward with the replat.

 

Mr. Arnold asked what floodplain level the property was in and the elevation.

Mr. Grooms stated that the property was in floodplain level AE and was an at-risk property, and that he was not sure of the elevation.

 

Mr. Wicker asked how long has the 10 foot dedication been vacated.

Mr. Grooms stated that he believed it was vacated sometime last year.

 

Mr. Wicker asked if it was vacated by the City.

Mr. Grooms stated yes.

 

The public hearing was opened at 6:07 PM.

The public hearing was closed at 6:07 PM.

 

Mr. Arnold asked if the item could be tabled until the commission was given information about the elevation of the property.

 

The owner of the property asked to speak.

Mr. Dugie asked Mr. Doan if it the property owner was allowed to speak at that time.

Mr. Doan stated that the decision on whether the owner can make a comment is made by the Chairman.

 

Mr. Doan asked if elevation is part of subdivision ordinances required for platting.

Mr. Granata stated that the plat has a benchmark on it, does have an elevation, and that the location of the property being in a floodplain or not in a floodplain is not dealt with during the subdivision phase, but during the building permit phase, which requires it to comply with the City?s floodplain ordinances. Mr. Granata also stated that the benchmark for the site is at 13.48 feet.

 

Mr. Dugie asked if the owners had brought the replat forward.

Mr. Granata stated yes.

 

Mr. Turner agreed to allow the property owner to speak before the commission.

 

Ken Gurley ? property owner ? stated that he and his wife purchased the property a few years ago; the property had previously been a fishing shack. Mr. Gurley also stated that they [he and his wife] had filed a site plan with the City, which had initially been approved, but after filing for a building permit they were told they would need to replat the site. Mr. Gurley also stated that he was aware that the foundation of property would have to be brought up to 15.5 feet and will require some fill, and that he will resubmit a new site plan after the replat was considered.

 

Mr. Dugie motioned to approve the Partial Replat of Lots 1, 2, 13, 14 and 50? x 10? Alley of Clear Lake Subdivision.

Mr. Wicker seconded the motion.

The motion passed unanimously by a vote of 6-0-0.

 

IV.              Staff Comments

A.     Monthly Report

Ryan Granata, Planning Manager, presented for the City of League City and stated that the monthly reports were included in this meetings? packet for the commissioner?s review.

 

B.     Ordinance Updates

Ryan Granata, Planning Manager, presented for the City of League City and  stated that staff was currently in the process of making ordinance revisions, and that a new subdivision ordinance was being drafted, along with an up-dated sign ordinance, which will possibly be brought before the commission after the 1st of January. 

 

Mr. Granata also stated that for the first or second quarter of next year City staff would like to work on commercial design standards and an ordinance for the allowance food trucks. Mr. Granata also commented that the winery the commission had approved last month withdrew and will not be going forward.

 

Mr. Wicker asked if the Cabela?s development was still going forward.

Mr. Granata stated yes, the construction was nearly complete, with plans to open in early next year, and that Staff has begun discussions for the second part of development, which will be the out-lots, and will be reviewing the site plans for that project.

Doug Turner adjourned the meeting at 6:14 PM.
