The privilege of speaking at this time is limited to the following persons: residents, persons having an ownership interest in property or a business within the City, or their attorneys.

A statement of no more than 3 minutes may be made. There will be no yielding of time to another person. State law prohibits members of the Planning and Zoning Commission from commenting on any statement or engaging in dialogue without an appropriate agenda item being posted in accordance with the Texas Open Meetings Act. Comments should be directed to the entire Planning and Zoning Commission, not individual members of the Planning and Zoning Commission or staff. If addressing a specific agenda item, speakers must keep their remarks specific to the item being considered by the Planning and Zoning Commission. Any speaker making personal attacks or using vulgar or profane language shall forfeit his/her remaining time and shall be seated.

IV.   Public Hearing and Action Items from Public Hearing

A.   Hold a public hearing and make a recommendation to City Council on Special Use Permit application, SUP16-09 (Joe Hudson Collision Center), generally located approximately 800 feet north of Big League Dreams Parkway along the west side of the Gulf Freeway (I-45).

B.  Hold a public hearing and take action on a Replat  League City Orange Groves, Lot 3R, Block 3, generally located south of League City Parkway (SH 96), east of Meadowlark Lane, and west of Pecan Orchard Lane.

V.   New Business

A.  Consider and take action on a Master Plan Lakes in Bay Colony, generally located north of FM 517, east of Calder Road, and west of FM 646.

B.  Consider and take action on a Preliminary Plat Lakes in Bay Colony Section 8, generally located north of FM 517, east of Calder Road, and west of FM 646.

C.  Consider and take action on a Final Plat Bay View Section 4, generally located north of Cross Colony Drive, south of Ervin Street, and east of Calder Road.

D.  Consider and take action on a Master Plan Tuscan Lakes #20, generally located south of League City Parkway (SH 96), and west of Tuscan Lakes Boulevard.

E.  Consider and take action on a Master Plan Magnolia Creek, generally located along the north and south sides of League City Parkway, and along the east and west sides of Bay Area Boulevard.

F.   Consider and take action on a Preliminary Plat Magnolia Creek Section 15, generally located south of League City Parkway, and east of Bay Area Boulevard.

I.                    Call to Order and Roll Call of Members

Douglas Turner opened the meeting at 6:00 PM.

II.                 Approval of Minutes

A.     January 17, 2017

 

Mr. Bindhammer made a motion to approve the January 17, 2017 minutes.

Mr. Arnold seconded the motion.

The motion passed unanimously by a vote of 5-0-0.

 

III.              Citizen Communication

No citizen comments were made.

 

IV.              Public Hearing and Action Items from Public Hearing

Hold a public hearing and make a recommendation to City Council on Special Use Permit application, SUP16-09 (Joe Hudson Collision Center), generally located approximately 800 feet north of Big League Dreams Parkway along the west side of the Gulf Freeway (I-45).

Kris Carpenter, Planning Manager for the City of League City, presented the request and informed that City staff recommended approval.

 

Mr. Alderman asked, in regard to filling the detention pond located in the front of the property and the proposed vertical wall in the rear, if the applicant would be required to go through a permit process.

Mr. Carpenter answered future plans were to move the detention pond to the rear of the property, which would go through a permit process.

 

Ms. Ramirez inquired as to what material the 6-foot screening fence would be made of.

Mr. Carpenter answered it would be made of wood.

 

The public hearing was opened at 6:08 p.m.

With no comments received, the public hearing was closed at 6:08 p.m.

 

Mr. Arnold made a motion to approve a Special Use Permit application, SUP16-09 (Joe Hudson Collision Center), generally located approximately 800 feet north of Big League Dreams Parkway along the west side of the Gulf Freeway (I-45).

Mr. Bindhammer seconded the motion.

The motion passed unanimously by a vote of 5-0-0.

 

B.      Hold a public hearing and take action on a Replat - League City Orange Groves, Lot 3R, Block 3, generally located south of League City Parkway (SH 96), east of Meadowlark Lane, and west of Pecan Orchard Lane.

Brittany Hathaway, Planner for the City of League City, informed the case was withdrawn by the applicant.

 

No action was taken on this request.

 

V.                 New Business

A.      Consider and take action on a Master Plan - Lakes in Bay Colony, generally located north of FM 517, east of Calder Road, and west of FM 646.

Brittany Hathaway, Planner for the City of League City, presented the request and informed that City staff recommended approval.

 

Mr. Arnold asked if the detention pond would be reduced, and asked if the reduction would result in any detention issues.

Ms. Hathaway confirmed the size would be reduced.

Mr. Sims stated there were no issues in regard to the reduction in size of the detention.

 

Mr. Bindhammer made a motion to approve a Master Plan - Lakes in Bay Colony, generally located north of FM 517, east of Calder Road, and west of FM 646.
Ms. Ramirez seconded the motion.

 

The motion passed unanimously by a vote of 5-0-0

 

B.      Consider and take action on a Preliminary Plat - Lakes in Bay Colony Section 8, generally located north of FM 517, east of Calder Road, and west of FM 646.

Brittany Hathaway, Planner for the City of League City, informed that the plat met all State and local requirements and City staff recommended approval.

 

Mr. Alderman made a motion to approve a Preliminary Plat - Lakes in Bay Colony Section 8, generally located north of FM 517, east of Calder Road, and west of FM 646

Mr. Arnold seconded the motion.

 

The motion passed unanimously by a vote of 5-0-0

 

C.      Consider and take action on a Final Plat - Bay View Section 4, generally located north of Cross Colony Drive, south of Ervin Street, and east of Calder Road.

Kayla Davis, Planner for the City of League City, informed that the plat met all State and local requirements and City staff recommended approval.

 

Mr. Alderman inquired as to the location of the detention pond.

Mr. Sims informed that the detention was off-site and located in a separate section of the development.

 

Mr. Arnold made a motion to approve a Final Plat - Bay View Section 4, generally located north of Cross Colony Drive, south of Ervin Street, and east of Calder Road.

Mr. Bindhammer seconded the motion.

 

The motion passed unanimously by a vote of 5-0-0

 

D.      Consider and take action on a Master Plan - Tuscan Lakes #20, generally located south of League City Parkway (SH 96), and west of Tuscan Lakes Boulevard.

Korrie Becht, Senior Planner for the City of League City, presented the request and informed that City staff recommended approval.

 

Mr. Alderman asked if there were issues with residential property adjacent to commercial property.

Ms. Becht replied that staff took into consideration the adjacent commercial zoning and had addressed it through the site plan. She informed that a park area with a vegetative buffer would be provided and the commercial property would provide a 35 to 40-foot buffer with a 14-foot tall fence along the loading dock area, in addition to an 8-foot tall fence with extra plantings.

 

Ms. Ramirez asked if the homeowners were aware of the proposed zoning change.

Ms. Becht informed that there were currently no homeowners in the area as it had not been built out.

 

Mr. Alderman made a motion to approve a Master Plan - Tuscan Lakes #20, generally located south of League City Parkway (SH 96), and west of Tuscan Lakes Boulevard.

Ms. Ramirez seconded the motion.

 

The motion passed unanimously by a vote of 5-0-0

 

E.   Consider and take action on a Master Plan - Magnolia Creek, generally located along the north and south sides of League City Parkway, and along the east and west sides of Bay Area Boulevard.

 

F.   Consider and take action on a Preliminary Plat - Magnolia Creek Section 15, generally located south of League City Parkway, and east of Bay Area Boulevard.

Korrie Becht, Senior Planner for the City of League City presented the requests. She informed that the plat met all State and local requirements and stated that City staff recommended approval of the Master plan and Preliminary Plat.

 

Mr. Arnold asked if the 50-foot lots were intended for single family dwellings.

Ms. Becht confirmed and stated, as the PUD fell under the 1999 zoning ordinance, the development would be allowed to take advantage of a provision that allowed patio homes.

 

Mr. Alderman inquired if the same people owned the southern tract, and inquired as to why the street was changed.

Ms. Becht answered she did not believe the owners were the same as the other tract was not part of Magnolia Creek nor was she aware of proposed development.

Mr. Stoops, applicant, informed that the area to the south was the Lloyd Tract PUD and informed that there was a thoroughfare about 1,000 feet south, of which would connect to the stub street whenever the property was built out.

 

Mr. Arnold asked if Mr. Stoops conducted a study to see if the 50-foot lots were marketable in League City.

Mr. Stoops answered that buyers were asking for 50-foot lots due to a price point issue and informed builders have already been committed for the lots.

 

Ms. Ramirez asked Staff if the applicant was restricted to only build patio homes due to it falling under that section of the 1999 zoning ordinance,

Ms. Becht answered that the ordinance did not restrict the size of the home, rather just the size of the lot.

Mr. Stoops informed that the 1999 zoning ordinance was the first zoning ordinance for League City of which only had one category for residential zoning. The residential category only listed that the smallest lot width was 50-feet. It did speak to patios, which allowed for patio homes, but it did not restrict the 50-foot lots to only be developed with patio homes.

 

Ms. Ramirez noted that 270 additional lots were approved and asked if Staff worked with the school district to notify of the increase in population.

Ms. Becht informed that part of the application process involved requiring the applicant to notify the school district of the increase of homes.

 

Mr. Alderman made a motion to approve a Master Plan - Magnolia Creek, generally located along the north and south sides of League City Parkway, and along the east and west sides of Bay Area Boulevard and a Preliminary Plat ? Magnolia Creek Section 15, generally located south of League City Parkway, and east of Bay Area Boulevard.

Mr. Bindhammer seconded the motion

The motion passed unanimously by a vote of 5-0-0

 

VI.              Staff Comments

Frankie Legaux requested the Commission to notify Staff if anyone was unable to attend a meeting in order to ensure quorum.

Kris Carpenter informed, on the next PZ commission agenda, he would provide a topic in regard to development from a behind the scenes view.

VII.            Adjournment

Douglas Turner adjourned the meeting at 6:32 PM.
