III.               Citizen Communication

The privilege of speaking at this time is limited to the following persons: residents, persons having an ownership interest in property or a business within the City, or their attorneys. A statement of no more than 3 minutes may be made. There will be no yielding of time to another person. State law prohibits members of the Planning and Zoning Commission from commenting on any statement or engaging in dialogue without an appropriate agenda item being posted in accordance with the Texas Open Meetings Act. Comments should be directed to the entire Planning and Zoning Commission, not individual members of the Planning and Zoning Commission or staff. If addressing a specific agenda item, speakers must keep their remarks specific to the item being considered by the Planning and Zoning Commission. Any speaker making personal attacks or using vulgar or profane language shall forfeit his/her remaining time and shall be seated.

 

IV.               New Business

A.     Consider and take action on a Master Plan Revision – Bay Colony West Revision #12, generally located north of FM 517 and west of Calder Road.

B.      Consider and take action on a Preliminary Plat – Bay Colony Pointe West Section 11, generally located west of Calder Road and south of Granite Gate Lane.

 

V.                  Public Hearings & Action Items

A.     Conduct a public hearing and make a recommendation to City Council on a Zoning Map Amendment – MAP-17-0001 (Bay View Section 4), a request to rezone approximately 1.19 acres from “OS” (Open Space) to “RSF-5” (Residential Single-Family with a minimum lot size of 5,000 square feet), legally described as all of Lots 10, 11, and 12, and a portion of Lots 8, 9, 13, and 14, Block 2, Bay View Section 4, generally located east of Calder Road, along Dale Ridge Lane, Terrace Cliff Lane, and Rolling Creek Lane, with the addresses of 260 and 262 Dale Ridge Lane, 3015 and 3013 Terrace Cliff Lane, and 265, 263, and 261 Rolling Creek Lane in League City, Texas.

B.      Conduct a public hearing and make a recommendation to City Council on an Ordinance amending Chapter 125 of the Code of Ordinances of the City of League City entitled “Zoning” by creating Section 125-76 entitled “Olde Towne Districts” to create a form based code for the Downtown Revitalization Area.

C.     Conduct a public hearing to receive comments from the Board and members of the community regarding an Ordinance amending Chapter 98 of the Code of Ordinances of the City of League City entitled “Streets, Sidewalks and Other Public Places” by adding Article VII, entitled “Network Providers in the Public Right-of-Way”, to address the installation of network nodes and related equipment in the public right-of-way.

 

VI.               Other Business

A.     The Director of Planning and Development to provide a presentation to and request comments from the Planning and Zoning Commission regarding upcoming amendments to the Subdivision Ordinance.

II. Approval of Minutes
A. July 31, 2017
Mr. Alderman made a motion to approve the July 31, 2017 minutes as presented.
Mr. Bindhammer seconded the motion.
The motion passes by a vote of 6-0-0.


III. Citizen Communication
No Citizen Comment

Mr. Schweinle made a motion to suspend the rules to move Item V. C.
Mr. Walding seconded the motion.
The motion passes by a vote of 6-0-0.


C.

Michelle Villarreal, Deputy City Attorney, gave a presentation on an ordinance related to the installation of network nodes and related equipment in the public right-of-way.


Ms. Villarreal, answered questions given to her prior to Planning and Zoning Meeting.

IV. New Business
A. Consider and take action on a Master Plan Revision – Bay Colony West Revision #12, generally located north of FM 517 and west of Calder Road.
Kris Carpenter, Planning Manager, gave a presentation on Master Plan Revision – Bay Colony West Revision #12.


Mr. Alderman made a motion to approve Master Plan Revision – Bay Colony West Revision #12.
Mr. Schweinle seconded the motion.

The motion passes by a vote of 6-0-0.



B.
Consider and take action on a Preliminary Plat – Bay Colony Pointe West Section 11, generally located west of Calder Road and south of Granite Gate Lane.

Kris Carpenter, Planning Manager, informed that the Plat met all State and local requirements and staff recommended approval.

Mr. Bindhammer made a motion to approve Preliminary Plat – Bay Colony Pointe West Section 11.
Mr. Walding seconded the motion.
The motion passes by a vote of 6-0-0.


V. Public Hearings and Action Items from Public Hearings
A. Mr. Alderman asked if the flood plain changes will have an impact on the area.
Mr. Carpenter responded that it’s not going into a flood plain, it’s changing categories.

Mr. Turner, opened the Public Hearing at 6:18 p.m.

Matt Stoops, Kerry Gilbert & Associates Applicant, stated he is here to answer any questions on this Amendment.

Mr. Walding asked if the applicant will eventually build in the green area on the map.
Mr. Stoops responded that it would not be built on, and it has already been platted as restrictive reserve for parks.

Mr. Turner, closed the Public Hearing at 6:20.

Mr. Walding made a motion to approve Zoning Map Amendment – Map-17-001 (Bay View Section 4).
Mr. Lee seconded the motion.

The motion passes by a vote of 6-0-0.


B.
Conduct a public hearing and make a recommendation to City Council on an Ordinance amending Chapter 125 of the Code of Ordinances of the City of League City entitled “Zoning” by creating Section 125-76 entitled “Olde Towne Districts” to create a form based code for the Downtown Revitalization Area.
Brad Lonberger, Consultant with Gateway Planning, gave a presentation on Section 125-76 entitled “Olde Towne Districts” to create a form based code for the Downtown Revitalization Area.


Mr. Bindhammer asked if Citizens in the community are aware of the Downtown Revitalization.
Mr. Lonberger explained multiple outreach efforts the city had completed.

Mr. Alderman asked if by allowing Balconies in the right-of-way, are we confident FM 518 will never
be widened and those trees will never be removed.
Mr. Lonberger responded there are requirements to space back from those trees, where the drip line exceeds the existing setback so builders are not disrupting the tree drip line. In addition, the applicants are allowed to place balconies in the right-of-way currently with an encroachment agreement.

Mr. Carpenter stated that even if it meets the standards in this Ordinance we can still deny balconies in the row if there is some other factor that comes into play.

Mr. Turner Opened the Public Hearing at 6:32 p.m.
With no comments received, Mr. Turner Closed Public Hearing at 6:33 p.m.


Mr. Alderman made motion to approve Section 125-76 entitled “Olde Towne Districts” to
Create a form based code for the Downtown Revitalization Area.
Mr. Bindhammer seconded the motion.

The motion passes by a vote of 6-0-0.



VI. Other Business
A. The Director of Planning and Development to provide a presentation to and request comments from the Planning and Zoning Commission regarding upcoming amendments to the Subdivision Ordinance.
Paul Menzies, Director of Planning and Development, gave a presentation on the upcoming amendments to the Subdivision Ordinance.

Mr. Alderman asked who would enforce the HOA to maintain the Drainage facilities.
Mr. Menzies responded it would be in the code, similar to the requirements that maintain
the HOA parks.
Mr. Menzies stated if the HOA doesn’t properly maintain the ponds, then it becomes a code enforcement issue.

Mr. Walding asked what the advantage was of the city maintaining the ponds, and why is the city doing this.
Mr. Menzies responded it could be deemed in the public’s interest to maintain the ponds, however, as the city has developed, each one of these detention facilities serves only that the development.

Mr. Walding stated the HOA should maintain the ponds and not put the tax burden on
the citizens of League City.

Mr. Schweinle stated the HOA’s are managed by private entities not by citizens.

Mr. Lee stated the HOA and Developers want those detention ponds maintained properly
because they are amenities, the city should not have to maintain them.

Mr. Lee stated the curb trees have destroyed sidewalks, and curbs.
